-
Критическая или лидирующая роль;
-
Награды;
-
Повышенная зарплата;
-
Судейство;
-
Членство в ассоциации;
-
Авторство статей;
-
СМИ;
-
Участие в выставках, конференциях, мероприятиях;
-
Вклад в индустрию;
-
Shamayev Business Law?

Shamayev Business Law.

Ukrainian software developer got Green Card
The U.S. is home to many of the world’s largest and most influential technology companies, such as Google, Facebook, Microsoft, and Apple. These companies offer a wide range of career opportunities and competitive salaries that attract top talent from around the world. This is one of the many reasons why foreign IT specialists strive to relocate to the U.S. to expand their career opportunities.
In today’s article, we will tell you the story of our client, a very talented IT specialist, who, like many other international professionals in this industry, has decided to move to the U.S. to give a boost to his career and build a better life.
Introducing you to Max Bartkov. A 26-year-old software developer from Ukraine initially contacted Shamayev Business Law to help him apply for an O-1 non-immigrant, temporary visa but ended up getting a Green Card petition approved.
How did this happen? We’ll break it down for you.
Back in June 2021, Max realized he needs to change his life for the better and came to the conclusion that moving to the U.S. would be perfect for him and his career as a software developer.
“When I was considering where to relocate, I didn’t actually see many choices there. Europe was not an option for me. Despite the fact that some of the biggest tech hubs are located there (e.g. Germany, the UK), the taxes are extremely high in these countries. That’s why I chose the United States. Besides, the salaries in the U.S. are higher than those in the EU.”, — says Max.
After the research was done, Max figured he could qualify for an O-1 talent visa. So he came to us with a specific request to prepare his O-1 visa case. At that point, the idea of applying for a Green Card visa didn’t even cross his mind, as it would be too much of a stretch for him.
So we initiated the O-1 visa process. In the beginning, his visa package seemed very raw. Our licensed attorney Stanislav Shamayev created a case strategy with a detailed action plan on how to improve the case. For several months Max has been working on improving certain visa criteria. At the same time, our professional team, while doing some digging, has discovered some of his achievements that simply weren’t there at the beginning.
Finally, we realized! We actually have a great EB-1A case. Over the course of several months, an O-1 case has transformed into an EB-1A Green Card case, which is quite an achievement.
FYI: O-1 talent visa is not as prestigious as EB-1A. Here’s why:
The O-1 visa is not as demanding in terms of its requirements and criteria, however, it’s still a non-immigrant visa, meaning you won’t get permanent residence in the U.S. Whereas, EB-1A visa gives you a Green Card and a Lawful Permanent Resident status.
In December 2022, Max got his EB-1A petition approved!
During a recent Live interview, Max told us, how he decided to choose our company among many other immigration firms existing on the market.
“Since I’m a pretty meticulous person I usually conduct deep research before buying a service or a product. Choosing an immigration lawyer was no exception. While looking for information on that matter, I came across several specialists and Stanislav Shamayev popped out first on the list. There was another lawyer I got interested in but as it turned out he didn’t have a license, so my choice was pretty obvious.”
Max also shared his opinion on how was it working with Shamayev Business Law.
“Working with you, guys, was so easy. Response time was at its best! I got an answer to any question I had in 10 minutes. This made our interactions very productive and effective.”
Indeed, at Shamayev Business Law we are highly dedicated to our clients, as their success is our success. We provide 24/7 support, meaning our clients can address their questions at any time, day and night, and we’ll come right back with a thorough answer. Our Company is rooting for quality in everything we do.
But we don’t stop there! We constantly improve our services and come up with new ones to bring more value to our clients.
In a more recent development, we have introduced a new service called Complex Immigration Planning.
This innovative service, created exclusively at SBL, is a game-changer in the immigration industry.
Get ready for an immigration journey like no other! Our team of experts is here to guide you every step of the way. We don’t just offer basic consultations like other immigration attorneys. We take the time to analyze your unique situation and create a personalized strategy just for you.
Our team is led by an experienced licensed lawyer and made up of qualified specialists who will gather all the important information about you. We want to know your achievements, skills, and education to make sure your case strategy is precise and comprehensive. Whether you’re immigrating for work, study, or personal reasons, we’ve got you covered!
Ready to take your immigration case to the next level?
Complex Immigration Planning is a two-step process that is specifically designed to provide you with the most precise and successful strategy for your immigration case.
Complex Immigration Planning (CIP) is divided into two very important stages
Stage 1: In-depth Interview & Data Collection
During this 60-minute session, a qualified data collection manager gathers additional, more specific, and profound information about the client. The data collection manager goes through visa criteria one by one and detects the upsides and the downsides of the client’s case. The manager analysis every single achievement and piece of evidence the client has at this starting point.
Stage 2: Initial Case Development Strategy
At this stage, the client meets our licensed lawyer, Stanislav Shamayev. During a 30-minute meeting, he creates an initial case strategy based on the information gathered by the data collection manager.
He provides legal advice on the development of the case. He presents a step-by-step action plan on how to meet visa criteria and what documents are needed. He gives the client an understanding of where the case development is going and how to make the case stronger.
Free Evaluation of your case and CIP altogether make up a 3-step case development strategy, that shapes up the client’s case. This system increases the quality of the immigration package to the level the other immigration firms can’t secure.
Want to make your first step towards your future in the U.S., just fill in this form and get your Free Evaluation of your situation from our attorney.

Strong recommendation letters
If you’re planning to apply for a U.S. Talent Visa, you know how complex and time-consuming the process can be. One of the most crucial components of your application is Recommendation Letter. In this article, we’ll discuss why Recommendation Letters are vital for your U.S. Talent Visa application and how they can enhance your immigration case. We’ll also provide a detailed guide on what Recommendation Letters entail, along with some tips for writing a successful one.
Why Recommendation Letters are Vital for U.S. Talent Visa Applications
A Recommendation Letter for Immigration is a letter written by an expert in your field, highlighting your achievements and exceptional skills. The USCIS requires Recommendation Letters as part of the visa application process to evaluate the petitioner’s qualifications and skills and determine whether they qualify for a U.S. visa. These letters help immigration officers understand the context and significance of your work.
Moreover, immigration officers are rarely experts in your field, so they rely on the evidence submitted, including articles, publications, memos, expert testimony, and Recommendation Letters. For U.S. Talent Visa applicants, Recommendation Letters show recognition of their work as high-level specialists.
What to Consider when Collecting Recommendation Letters for Your Application
When collecting Recommendation Letters for your U.S. Talent Visa application, it’s essential to obtain them from independent sources outside your immediate circle. These letters carry more weight as they provide objective proof of your accomplishments. You should aim to get these letters from experts in your field or related fields.
It’s important to understand that people may want to recommend you, but they are also busy and may not have the time to write a full letter. You may want to provide a brief outline of what they can include in their letter, such as your contributions to your field, any achievements or awards, and what they think of you. If the recommended person doesn’t have time to write the letter, you can write it yourself, and they can review it for accuracy and sign it.
What to Include in a Recommendation Letter
A successful Recommendation Letter should be able to specifically address your accomplishments and contributions. It’s better if the person writing you a Recommendation Letter knows about your research and contribution enough to specify them in the recommendation letter.
How Many Recommendation Letters Should You Submit?
USCIS does not mandate how many Recommendation Letters to submit, but a minimum of ten to fifteen is recommended. The reason for this is that USCIS officers are most likely not experts in your field, and they determine your qualifications based largely on the contents of your Recommendation Letters.
Here’s a breakdown of what you should include in your Recommendation Letter:
1. Introduction
A brief explanation of the nature of the Recommendation Letter
2. Information about the expert/writer
?The qualifications of the writer, which substantiate their ability to write the Recommendation Letter
?The writer’s role
?The writer’s association with the applicant
?The familiarity they have with the applicant’s work
?Any other supporting evidence that validates the writer’s capacity in relation to the petitioner’s achievements and the significance of their role
3. Information about the applicant
The applicant’s relevant knowledge, indicating their professional or academic experience, including their published academic papers and relevant speeches.
?An evaluation of how the applicant satisfies the NIW standards.
?Any proof indicating that the petitioner is capable of progressing in their intended pursuit.
?Any published material that features the petitioner.
?Any evaluations that the petitioner has previously conducted.
?All relevant accolades, grants, and memberships in associations that demand exceptional accomplishments.
?An explanation of how the petitioner’s work would contribute to the betterment of the country.
4. Conclusion
Final Tips
A recommendation letter is a crucial component of your U.S. talent visa application. It is essential that you secure strong, detailed, and specific recommendation letters that demonstrate your expertise and achievements in your field.
✅ Ensure the letters come from experts in your field or related fields
✅ Avoid using too many superlatives and stock phrases as the effectiveness of the letter depends on the substantive information it provides about your qualifications
✅ They should focus on your contributions to the field and the potential benefits you can bring to the United States
✅ The more specific the letters are, the better, as this will help USCIS officers understand the significance of your achievements and contributions in your field
✅ A professional letterhead and a signature are necessary, and one must keep in mind that these letters are critical for meeting USCIS regulatory requirements. They differ from general recommendation letters and require specificity to be effective
By following the guidelines and tips outlined in this article, you can strengthen your application and increase your chances of obtaining a U.S. talent visa. Remember, the immigration process can be complicated and stressful, but with the right preparation, you can navigate it successfully and achieve your dreams of working in the United States.

How to get a Green Card through investment?
Many people are looking for ways to invest and ensure a better future for their families. The United States offers great infrastructure, top education for children, progressive medicine, and other opportunities for a high-quality life. This attracts investors and businessmen from all around the world. In this article, I’m going to discuss how to become a lawful resident by investing substantial capital in financing a business in the US through an investment visa EB-5.
Investment EB-5 visa is a governmental program for Immigrant Investors to become lawful residents by investing substantial capital in financing your business project or project from a regional center in the U.S. It was created in 1990 to allow foreign investors to become legal permanent residents of the U.S. According to the official statistics, 2,949 EB-5 visas were issued in 2021.
The EB-5 visa let you immigrate in two ways: passive or active investment. Passive investment involves $800 000+ investment in Regional Centers, which were accredited by the US government. Or you have another option — active investment in your business, which starts from $1 050 000. The main difference: in the passive investment, you can return your money with %.
Also, if you choose the passive investment, then you give your money to some project which is licensed by the United States Government and they will take care of everything for you.
The EB-5 visa has many advantages, so you can see for yourself why this type of visa is so beneficial. Moreover, you can find a list of the EB-5 visa requirements down below, as well as a step-by-step guide explaining how to apply for it.
EB-5 Program benefits
- There are no requirements for education and knowledge of the English language.
- A fast and reliable way to get citizenship.
- You can apply for U.S. citizenship after 5 years
- The money you’ve invested will return within 5–7 years in the case of passive investment
- It gives you access to the U.S. healthcare system
- With the EB-5 visa comes a Green Card for you and your family
One of the main EB-5 benefits is that you can immigrate to the U.S. with your immediate family, including your children under 21 that are not married yet.
Things you should know about the immigration process:
- Within 12 months you will receive your U.S. visa
- Within 5–7 years, investments will return in full.
Crucial steps in obtaining the EB-5 investment visa:
- Preliminary assessment of the case by a lawyer
- Choosing an investment project
- Filing an immigration petition (I-526) in the U.S.
- Immigration Approval of the petition
- Interview at a US consular office with an investor
- Getting a Green Card
On my YouTube channel, Shamayev Business and Talent Visas, I have a lot of videos with detailed information about this program. As with any other type of visa, new regulations and updates are introduced every year on EB-5 visas. Now let’s look closer to the latest criteria and see how you can immigrate as an investor.
EB-5 Visa Documents
- All documents confirming the legality of the origin of your investment funds;
- Petition I-526
In my company, Shamayev Business Law, we specialize in several business and investment visas: ЕВ-5, small investment visa E-2, and business visa L-1. In this article, I will focus on the criteria of the EB-5 visa that allows you to immigrate to the United States through 2 types of investments.
Investment amount
I bet this question has already slipped through your mind: “What is the investment amount for the EB-5 visa program?”. The program has a minimum and maximum entry threshold. To obtain a Green Card through the EB-5 program, you need $800,000 of investment. This is the minimum investment amount if you are investing in a secure project in the target TEA region. The other option is investing $1 million 50 thousand in your own business. If you are investing in your own business, you need to create 10 full-time jobs. But it is also important to have a legal source of funds.
3 main requirements for the EB-5 visa:

Since IT specialists are in high demand in the U.S., there are many ways for foreign professionals to immigrate to the country. Here are the most common ones.
EB-1A Visa
This immigration visa is a great option for people with extraordinary abilities like Information Technology professionals, who have profound knowledge of computer science. The greatest benefit of this visa program is that you will receive your green card once the EB-1 is granted. This means that the EB-1 holder gets permanent residency in the U.S. This type of visa does not require any investment or a job offer from a U.S. company.
The EB-1A is a first-preference visa, which means it has the most stringent requirements among all green card categories. Despite the fact that this immigration program has a demanding list of criteria, you don’t need to satisfy all of them. In order to get your case approved, you only have to meet 3 out of 10 visa requirements! The key to receiving an EB-1 is to prove that you are in the top percentile in your field, meaning your achievements are recognized at the national or international level.
O-1 Visa
This visa has a lot of similarities to the EB-1A visa since both of them are talent visas. Just like the EB-1A program, O-1 does not require any investment. However, unlike the EB-1A, the O-1 visa is a nonimmigrant one, which means you won’t get a Green Card right away. It only allows temporary residency in the country.
Even so, throughout the O-1 program, you can change your status to EB-1 and get your Green Card. It’s important to mention that all O-1 applications demand sponsors or an employer in the U.S. The O-1 visa has lower standards for special talent, which makes it easier to obtain.
EB-2 Visa
The EB-2 is an immigration Green Card visa type, providing its holder permanent residency. It’s very important to emphasize that it’s also a work visa, which means having a sponsor or a job offer is crucial here. Being the second preference employment-based visa, it has a lower standard for the initial qualifications than the EB-1 visa, which makes it easier to prove. This immigration program is for specialists with advanced degrees (a baccalaureate + 5 years of progressive work experience in the field). However, getting this visa approved requires more waiting time if compared yet again with the EB-1 visa.
EB-3 Visa
It’s not hard to guess that this immigration visa is a third preference category. If you are a skilled worker, or professional, having at least 2 years of training or experience in your field and a bachelor’s degree. Notably, the EB-3 visa requirements are relatively lower than those of the EB-2, making it far more accessible. Remember, this visa program requires a permanent job offer from a U.S. employer.
You are a highly-skilled IT specialist thinking of moving to the United States to fulfill your potential but you don’t know which talent visa to apply for? Fill in our work visa questionnaire or talent visa questionnaire . We’ll review this information to determine which visa program fits you the best. And this is absolutely at no cost!
