Educators and curriculum developers: EB-1A and EB-2 NIW, and how we prove recognition in education

Picture two scenarios:

  • A curriculum developer wrote a financial literacy program that is now used in forty education centers.
  • An English teacher has spent years training instructors for international language exams and reviews teaching materials for an academic publisher in the field.

They may call it ordinary work. In an EB-1A or EB-2 NIW petition, those same facts look different and carry weight: a methodology that others use, trained specialists working in the field, and expert review of other people’s materials.

USCIS looks for evidence of your work beyond your own school, university, or course. Educators often have more of this evidence than they realize, but it’s scattered: in correspondence, in competition records, in program implementation records, in expert opinions.

What USCIS counts

Below are typical situations educators face, along with the EB-1A criteria (8 CFR § 204.5(h)(3)) they may fit. In EB-2 NIW, the same materials partly show that you are well positioned to advance the proposed endeavor.

Your experience EB-1A criterion Supporting evidence
A methodology or program you authored that was adopted by outside institutions Original contributions of major significance in the field Contracts and implementation records, number of students reached, results on external measures, letters from independent experts in the field
Articles in peer-reviewed journals, monograph chapters Authorship of scholarly articles in the field, in professional or major trade publications or other major media Scopus and Web of Science data; verified citation metrics; peer-review information
Serving on juries for professional competitions, reviewing programs, sitting on accreditation committees Participation as a judge of the work of others in the same or an allied field Official invitations to serve as an independent expert, reviewer selection rules, evaluation records, confirmation letters from journals and committees
Leading a department, program, or project at an organization with a distinguished reputation Leading or critical role for organizations or establishments that have a distinguished reputation Evidence of the organization’s standing (rankings, accreditations), position documents, a description of your personal areas of responsibility
Coverage of your work in professional or major industry publications Published material about the applicant in professional or major trade publications or other major media Full-text copies, publication circulation or readership data, evidence that the coverage is independent
Wins in competitions that select winners based on achievement Receipt of lesser nationally or internationally recognized prizes or awards for excellence in the field Competition rules, selection criteria, participant statistics, evidence of the award’s national or international standing. Project-specific grants generally do not count under this criterion; competitive fellowship awards are evaluated case by case.

Quick profile check

Try answering a few questions to see whether you may have the potential to meet the criteria:

  1. Has your program, textbook, or methodology been formally adopted by other organizations?
  2. Have you trained instructors at outside institutions, and can you give the number?
  3. Have you been invited to review others’ materials or judge professional competitions?
  4. Do other authors cite your publications?
  5. Are leaders of outside organizations willing to confirm specific implementation results in writing?

This checklist is not a substitute for a legal evaluation. It only shows which materials you may already have. Which category fits depends on the totality of your evidence, not on the number of “yes” answers. For a legal evaluation, you can request a free case evaluation from Shamayev Business Law.

EB-1A specifics for educators

The two-step evaluation standard (the Kazarian framework)

Since 2010, following Kazarian v. USCIS, USCIS has evaluated EB-1A cases in two steps:

  1. Counting the criteria. The officer checks whether the applicant meets at least three of the ten regulatory criteria, under the preponderance of the evidence standard (more likely than not).
  2. Final merits determination. If three criteria are met, the officer weighs all the evidence together. Does it show that the applicant has extraordinary ability, has sustained national or international acclaim, and is among the small percentage at the very top of the field?

An applicant can meet three criteria (for example, publications, judging, and membership in an association) and still be denied at the second step if the officer concludes that these achievements are typical for an experienced professional rather than a sign of extraordinary ability.

The more independent dimensions of professional achievement you can show, the more convincing the picture of an industry leader will be at the final merits stage.

EB-2 NIW and the Matter of Dhanasar requirements

EB-2 NIW requires an advanced degree (a master’s or higher). A bachelor’s degree plus five years of progressive experience in the field after earning the degree also qualifies, as does exceptional ability. Progressive experience means that the complexity of your work and your independence grew over time. You do not need to have moved into management.

The petition must satisfy the three prongs of Matter of Dhanasar.

  1. Substantial merit and national importance.

A plan to “teach at a specific school” and references to teacher shortages are not enough. Local teaching is valuable, but it is not national in scope.

You need a project that can be replicated. Examples include a model for training subject-matter teachers for districts with documented staffing shortages, an adaptive method for children with reading difficulties, or a system for integrating bilingual children with ready-to-use materials for other teachers.

  1. Well positioned to advance the proposed endeavor.

This is shown through your track record: methodologies you created and implemented, measurable results, publications in your field, and interest from potential users of your work, such as schools and universities. We covered this in the table above.

  1. On balance, beneficial to the United States to waive the job offer and labor certification requirements.

USCIS weighs the totality of the circumstances. The factors include how impractical it would be to obtain a labor certification for your work, whether the United States would benefit from your work even if other qualified US workers are available, and whether the national interest in your contribution is urgent. Urgency is one factor, not a requirement.

To support national importance, a petition can be strengthened with letters of interest from school districts, universities, and educational organizations that are prepared to use the applicant’s work.

How we work on your case

We start with your background, professional record, and an analysis of all your documented achievements, and then choose a strategy.

If you have publications, recognized awards, and documented adoption of your work, your profile may be a fit for EB-1A. If your strongest asset is the applied program itself, the focus can shift to EB-2 NIW: showing that the methodology is scalable and benefits US education as a whole.

Letters from independent experts can help: people who have not worked with you, but who use your work and can describe specifically what it has achieved. Letters from colleagues can be added, but they will not form the core of the case.

What’s most often missing

These are the weak spots we usually have to address before filing:

  • Reliance on years of service. Twenty years of experience and internal commendations show diligent work, but they prove neither extraordinary ability nor national importance.
  • No numbers on adoption. A methodology without data on how many organizations have used it and with what results can look like a personal initiative with no demonstrated value to the field.
  • Generalities instead of a plan. The statement “education matters to the country” is no substitute for a description of your contribution and how it will scale.

Bottom line

An immigration officer evaluates not how conscientious a teacher is on the job, but the scale of their professional impact. EB-1A requires evidence of recognized leadership in the field at the national or international level. EB-2 NIW offers a path for applied methodologies that can bring measurable benefit to US education.
