The employer submits documents to the Department of Labor to determine the wage for the specific job offered by that employer in the particular geographic location.
The employer tries to find local American workers in accordance with the job description and wage determined by the Department of Labor. If the employer cannot find a local worker:
The Department of Labor certifies that the employer was unable to find an American worker in that geographic location for the job description and wage offered. Additionally, an audit may occur at this stage if the Department of Labor has any questions or suspicions about the employer's recruitment process.
Submission of Form I-140 to the U.S. Immigration Service: At this stage, all the necessary documents should already be gathered. The employer must prove to the Immigration Service that:
- They need a specific worker for the position.
- They can afford to pay the wage established by the Department of Labor.
After the petition is approved, it's necessary to review a document from the Immigration Service containing statistics on different visa types and check two dates:
- "Filing Date" - The date when the Immigration Service received your petition.
- "Final Decision Date" - The date when the petitioner received the visa.
If you are in the U.S.:
Upon reaching the "filing date," you can submit Form I-485 for work authorization and permission to re-enter the country. This allows you to change your tourist or student status while waiting for your Green Card.
If you are outside the U.S.:
"Filing Date" - The date when you can submit documents to the embassy or consulate.
"Final Decision Date" - The date when you receive the visa.
