Immigration Digest: H-1B for big business, immigration reform debate, federal fraud probe opens

Microsoft Xbox cuts put H-1B fragility back in the spotlight

The Trump administration is trying to tighten restrictions around the H-1B program, yet major technology companies continue to use it for international hiring. Microsoft has received approval for 2,273 H-1B visas this year, with additional petitions still pending.

At the same time, the company announced 4,800 layoffs worldwide, including 1,600 employees in its Xbox division and around 600 workers in Washington state. The combination sparked a wave of criticism, with opponents of the program accusing big business of continuing to hire foreign professionals while cutting American jobs.

Microsoft has not linked the layoffs to H-1B hiring. Xbox head Asha Sharma attributed the cuts to the division’s financial performance. The situation has once again highlighted a contradiction at the center of current immigration policy: while the administration is trying to restrict employment-based visas, large companies continue to use the program to recruit highly skilled professionals from abroad.

World Cup moment and Houston shooting put immigration stakes in human terms

Two stories have renewed debate over U.S. immigration policy.

The first is that of Folarin Balogun, one of the standout players of the U.S. World Cup campaign. Born in the United States, he moved to the United Kingdom with his family just two months later and grew up there, eventually joining Arsenal’s youth academy at age eight. He later chose to represent the United States through his birthright citizenship, a principle the Trump administration is now seeking to restrict.

The second story concerns Lorenzo Salgado Araujo, who was killed during an ICE operation in Houston, although he was not the target. Salgado had no criminal record and had lived and worked in the United States for about 35 years.

Together, the two cases have renewed calls for comprehensive immigration reform.

H-1B fraud investigation signals closer scrutiny across the program

The Trump administration has launched a large-scale investigation into possible fraud within the H-1B program. The review is focused on staffing and outsourcing companies that, according to critics of the program, may have submitted inaccurate information about workers’ qualifications, salaries and other details in visa applications.

Jessica Vaughan of the Center for Immigration Studies argues that some intermediaries use H-1B to hire foreign professionals at lower wages and that some applicants may have misrepresented their education or professional background. Some politicians have claimed that violations are widespread, but there is no official data confirming those estimates.

The report also says the Department of Labor has identified possible links between some cases of visa fraud and criminal organizations. One proposed response has been to limit the role of staffing firms and labor contractors in the program.

Takeaway

Last week’s news highlights just how uneven the U.S. immigration landscape has become. Against a backdrop of new restrictions, investigations, and ongoing political debate, it is especially important to understand how these changes may affect your own situation and how to build the right strategy if you are only beginning to consider a future in the United States.
