The EB-1C visa is for international managers who have worked outside the USA and intend to move to or are already working in the USA in a managerial role under a different visa.

- One company outside the USA
- One company within the USA (startup with at least 1 year of operational activity/new business or purchase of an existing company)
- One or more owners with a majority of shares in both companies or
- One company owns shares of the other
Both companies in the USA and outside the USA must have affiliation, meaning both companies have common ownership.

3. A hybrid scheme where groups of people/companies own the same percentage in both companies
Affiliation must be maintained throughout the entire process until receiving the documents
- The petitioner works in a functional manager or executive/CEO position
- The petitioner has worked in the company for at least 1 year at the time of petition filing
- The company has been in operation for at least 1 year
- The company has 15+ employees under the petitioner's supervision
- Employees receive an official salary
- Employee salaries are not below the minimum income level
- Employees work a minimum of 35 hours per week
- The company has a three-level management structure: leader → managers → operational/administrative employees
- The company is profitable
- The affiliated company must acquire a company in the USA that has been in active operation for at least 1 year
- The company in the USA should have 8+ employees, with 2-3 of them reporting to the petitioner
